I. GENERAL PROVISIONS

  1. The personal data collected via the Internet Shop are administered by Salag Spółka z ograniczoną odpowiedzialnością Spółka Komandytowa with its registered office in Suwałki (registered and delivery address: ul. Szafirowa 5, 16-400 Suwałki e-mail:info@bergdeck.com) entered into the National Court Register - Register of Entrepreneurs by the District Court in Białystok, 12th Commercial Department of the National Court Register under KRS number: 0000142184, NIP: 844-19-41-084, REGON: 790744763, hereinafter referred to as the "Administrator" and being at the same time the Seller.
  2. The Customer's personal data is processed in accordance with the Personal Data Protection Act of 29 August 1997. (Journal of Laws 1997 No. 133, item 883 as amended) (hereinafter referred to as the Personal Data Protection Act) and the Act on Providing Services by Electronic Means of 18 July 2002. (Journal of Laws 2002 No. 144, item 1204 as amended).
  3. The controller shall take particular care to protect the interests of data subjects, and in particular to ensure that the data collected by it are processed lawfully; collected for specified and legitimate purposes and not further processed in a way incompatible with those purposes; materially correct and adequate in relation to the purposes for which they are processed; and stored in a form which permits identification of data subjects for no longer than is necessary to achieve the purpose of the processing.
  4. Any words, phrases and acronyms appearing on this website and beginning with a capital letter (e.g. Seller, Online Shop, Electronic Service) shall be understood in accordance with their definition contained in the Rules of the Online Shop available on the websites of the Online Shop.

II. PURPOSE AND SCOPE OF DATA COLLECTION AND RECIPIENTS OF DATA

  1. Each time, the purpose, scope and recipients of the data processed by the Administrator result from the actions taken by the Customer in the Internet Shop.

  2. Possible purposes for the collection of Customers' personal data by the Administrator:
      • conclusion and performance of a Sales Agreement or an agreement for the provision of an Electronic Service (e.g. Account).
      • Direct marketing of the Administrator's own products or services.
  1. Possible recipients of the personal data of the Customers of the Internet Shop:
      • In the case of a Customer who uses postal or courier delivery method in the Internet Shop, the Administrator shall make the collected personal data of the Customer available to a selected carrier or an intermediary performing the delivery on the order of the Administrator.
      • If the Customer uses electronic or credit card payment methods in the Internet Shop, the Administrator shall make available the collected personal data of the Customer to the selected entity handling the aforementioned payments
      • The Administrator may process the following personal data of Customers using the Internet Shop: first and last name; e-mail address; contact telephone number; delivery address (street, house number, flat number, postal code, city, country), residential/business/sitting address (if different from the delivery address). For Clients who are not consumers, the Administrator may additionally process the company name and tax identification number (NIP) of the Customer or Client.
  1. Providing personal data referred to in the above point may be necessary to conclude and perform a Sales Agreement or an agreement for provision of Electronic Services in the Internet Shop. Each time the scope of data required to conclude a contract is indicated in advance on the website of the Internet Shop and in the Rules of the Internet Shop

III. COOKIES AND USAGE DATA

  1. Cookies are small information in the form of text files which are sent by a server and saved on the website of the Internet Shop by a visitor (e.g. on the hard drive of a computer, laptop or smartphone memory card - depending on the device used by the visitor to our Internet Shop).   2. The Administrator may process data contained in Cookies when visitors use the website of the Internet Shop for the following purposes:
      • identifying Customers as logged in to the Online Shop and showing that they are logged in;
      • remembering the Products added to the basket for the purpose of placing an Order;
      • remembering data from completed Order Forms, surveys or Shop login details
      • adjust the content of the Internet Shop's website to individual preferences (e.g. with respect to colours, font size, page layout) and optimise the use of the Internet Shop's pages;
      • to keep anonymous statistics showing how the Internet Shop website is used;
      • popularisation of the Online Shop by means of the social network Facebook.com, Instagram.com,
  1. By default, most web browsers on the market accept the storage of cookies. You can determine the conditions for the use of cookies via your browser settings. This means that you can, for example, partially restrict (e.g. temporarily) or completely disable the storage of cookies - in the latter case, however, this may have an impact on some of the functionality of the Online Shop (for example, it may not be possible to follow the path of the Order through the Order Form due to the lack of remembering the Products in the basket during the subsequent steps

The settings of your Internet browser regarding cookies are important from the point of view of your consent to the use of cookies by our Online Shop - according to the regulations, such consent may also be expressed through the settings of your Internet browser. If you have not given your consent, you must change your browser's cookie settings accordingly.

  2. The Administrator also processes anonymised usage data related to the use of the Internet Shop (IP address, domain) to generate statistics which are helpful in administering the Internet Shop. This data is aggregate and anonymous, i.e. it does not contain any identifying characteristics of persons visiting the Internet Shop website. The data are not disclosed to third parties.

IV. BASIS FOR PROCESSING

  1. The provision of personal data by the Customer is voluntary, although the failure to provide the personal data specified on the website of the Internet Shop and in the Rules of the Internet Shop necessary for the conclusion and performance of a Sales Agreement or an agreement for the provision of Electronic Services shall result in the impossibility to conclude such an agreement.
  2. The basis for the processing of the Client's personal data is the need to perform a contract to which the Client is a party or to take steps at the Client's request prior to entering into such a contract. In the case of data processing for the purposes of direct marketing of the Administrator's own products or services, such processing shall be based on (i) the prior consent of the Customer or Client or (ii) fulfilment of the Administrator's legally justified purposes (pursuant to Article 23(4) of the Act on Personal Data Protection, a legally justified purpose is considered to be direct marketing of the Administrator's own products or services).

V. RIGHT OF CONTROL, ACCESS AND CORRECTION OF YOUR DATA

  1. The customer has the right to access and correct their personal data.

  2. Every person has the right to control the processing of data concerning him or her, included in the data filing system of the Administrator, and in particular the right to demand the data to be completed, updated, rectified, temporarily or permanently suspended or erased, if they are incomplete, outdated, untrue or collected in breach of the Act, or if they are no longer necessary for the purpose for which they have been transferred.
  3. If the Customer has given consent to the processing of data for the purpose of direct marketing of the Administrator's own products or services, the consent may be revoked at any time.
  4. If the Controller intends to process or processes the data of a Customer or Client for the purpose of direct marketing of the Controller's own products or services, the data subject shall also be entitled to (i) make a written, reasoned request to cease the processing of his/her data on account of his/her particular situation, or to (ii) object to the processing of his/her data.
  5. In order to exercise the rights referred to above, you may contact the Administrator by sending a relevant message in writing or by e-mail to the Administrator's address indicated at the beginning of this privacy policy.

VI. FINAL PROVISIONS

  1. The Internet shop may contain links to other websites. The Administrator urges to familiarise oneself with the privacy policy of other websites.

  2. The controller shall apply technical and organisational measures to ensure the protection of the processed personal data, appropriate to the risks and categories of data protected, and in particular shall protect the data against their disclosure to unauthorised persons, against their appropriation by an unauthorised person, against their processing in violation of the applicable legislation, and against their alteration, loss, damage or destruction.
  3. The Administrator shall adequately provide the following technical measures to prevent unauthorised persons from obtaining and modifying personal data sent electronically:
  • Security of the data set against unauthorised access.
  • Access to an Account only after providing an individual login and password.
